Terms and Conditions

These Terms and Conditions ("Agreement") govern your participation in any in person or online course provided by Train Me Education Pty Ltd ("TME"), including Mat.Certification, Reformer.Certification and Full.Certification. By enrolling in a course, you acknowledge that you have read, understood and agreed to these terms.

1. Your Enrolment

1.1 What you are agreeing to

Enrolment in a TME certification is a commitment to a scheduled program with fixed practical dates, set submission requirements, and a defined completion window. Please read the practical dates for your intake carefully before you enrol. If you already know you cannot attend a scheduled date, speak with us before you book rather than after.

1.2 Consumer rights

Nothing in this Agreement excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where a right cannot be excluded, TME's liability is limited, at TME's option, to resupplying the relevant services or paying the cost of having them resupplied. All other terms in this Agreement apply to the fullest extent permitted by law.

2. Attendance and Missed Practical Days‍ ‍

2.1 Every practical day must be covered

TME certifications are built around in person practical days. Every practical day scheduled for your intake must be covered before certification can be awarded. This is a requirement of the qualification, not a preference.

2.2 The TME Digital Catch Up

If you miss an in person practical day, you must purchase the TME Digital Catch Up for that day. The bundle includes: Pre-recorded seminars covering the exercises, teaching concepts and practical components your cohort worked through on the day you missed 2 x 30 minute online Zoom catch ups with an educator, so we can confirm the content has landed and work through anything you are unsure of The TME Digital Catch Up costs $350 AUD per practical day missed. One bundle is required for each day missed. It stands in place of the in person training for that day and is invoiced privately by TME Admin. Your Zoom catch ups are scheduled with your educator once the bundle is purchased.

2.3 This cost cannot be waived

‍ ‍The TME Digital Catch Up fee applies in every case and cannot be waived, reduced, deferred or credited. This includes, without limitation: illness, injury, pregnancy, mental health, family emergency, bereavement, caring responsibilities, work commitments, travel, transport failure, weather, and any other personal, medical or special circumstance. This is not a penalty. It covers the additional educator time and resources required to deliver that content to you separately, and it applies to every student equally so that the standard of a TME certification is consistent for everyone who holds one.

2.4 Partial attendance

A practical day is treated as attended only where you are present for the full scheduled day. Arriving late, leaving early, or being absent for a substantial part of a practical day may be assessed as a missed day at TME's discretion, in which case clause 2.2 applies. Your educator will confirm this with you on the day wherever possible.

2.5 Notification

If you know you will miss a practical day, you must notify TME Admin and your educator as early as possible, and in any case before the scheduled start time. Notification does not waive the fee under clause 2.3, but it allows us to prepare your catch up promptly and keep you progressing with your cohort.

2.6 Completing your catch up

The TME Digital Catch Up must be purchased and completed before you continue to subsequent practical days or submit work that depends on the missed content. Certification will not be awarded where a catch up remains outstanding.

3. Fees, Refunds, Deferrals and Extensions‍ ‍

3.1 No refunds

Subject to clause 1.2, all course fees are final and non refundable. This includes change of mind, personal circumstances, medical issues, change in availability, or finding the course more intensive or time consuming than expected.

3.2 Medical circumstances

Medical issues, including illness, injury and pregnancy, do not entitle participants to refunds, fee waivers, free catch up sessions, or automatic extensions. Where illness or injury causes you to miss a practical day, the TME Digital Catch Up must be purchased at the standard rate set out in clause 2.2. Deferral may be considered under clause 3.3 at TME's sole discretion and is not guaranteed.

3.3 Deferrals

Deferrals to a future intake may be considered at TME's sole discretion. If a deferral is approved: Your place in the current intake is forfeited Future intake dates are not guaranteed, and are subject to availability at the time If you cannot attend the dates offered, you are releasing your intake position A deferral does not waive fees already incurred, including any TME Digital Catch Up for days already missed Course fees paid are not refunded on deferral

3.4 Extensions

Extensions for submissions, practical requirements, or course completion can only be granted with prior written approval from TME administration, requested through the correct portal and following the correct protocol. Verbal or informal requests, including messages to educators, are not valid extension requests.

3.5 Late submission fees

If you miss a submission deadline, you will be given one grace period. After that, a late marking fee of $[AMOUNT] AUD may apply, as missed deadlines waste marking time our team has set aside for you. Any fees applied must be settled before certification is awarded.

3.6 Payment plans, defaults and penalties

Where you have selected a payment plan, all instalments must be paid in full and on time in accordance with the agreed schedule. Payments are processed automatically every 28 days. If a scheduled payment is unsuccessful, access to all online course materials, portals and resources will be immediately and automatically suspended until the outstanding payment is received. If four consecutive payment attempts are unsuccessful, TME reserves the right to apply a late payment penalty of $75 AUD per missed instalment, in addition to any outstanding course fees. In cases of continued non-payment, TME may, at its discretion: Maintain suspension of course access Terminate enrolment without refund Refer the outstanding balance for debt recovery Any administrative fees, penalties or recovery costs incurred as a result of failed payments are payable by you. Termination due to non-payment does not release you from your obligation to pay the full course fee.

3.7 Certification and outstanding balances

Certification will not be issued while any balance is outstanding, including course fees, TME Digital Catch Up fees, late submission fees, or payment plan penalties.

4. Completing Your Certification‍ ‍

4.1 Required components

All theory, quizzes, practical work, practical day attendance or catch ups, and apprentice hours must be completed to pass the course and receive certification.

4.2 Completion window

You have [12] months from your enrolment date to complete all requirements. Extensions beyond this window are available only under clause 3.4.

4.3 Submission attempts

You have as many attempts as you need. A TME team member will work with you to reach a passing standard for as long as it takes, at no additional fee. If a team member contacts you twice with no reply, you will be given a final 72 hour window to respond. If we still do not hear from you, this is treated as your official notice of withdrawal from the course, and clause 3.1 applies.

4.4 No guarantee of certification

Completion of the course does not guarantee certification. Certification is awarded on meeting the required standard. Additional 1:1 sessions beyond final submissions are at TME's discretion.

4.5 Course intensity

Courses may be intensive. Feeling overwhelmed or underestimating the time and effort required does not entitle you to refunds, deferrals or extensions unless specifically approved by TME administration.

4.6 Paid work during study

You may not take paid work related to teaching Pilates until your qualification is fully completed. Breaches may result in disciplinary action and invalidation of course hours or assessments.

5. Course Materials and Intellectual Property

5.1 Scope of use

All course materials, discussions, videos, presentations, manuals and any other content provided by TME are proprietary. You may use this content for your personal development and education only. Reproduction, distribution, resale or commercial use without written consent is prohibited.

5.2 Recordings

You may not record any TME session, in person or online, including Zoom catch ups, unless agreed in writing by TME in advance. Where a recording is agreed, it must not be shared beyond the agreed limits. TME may record online sessions for quality and training purposes and will advise you where this occurs.

5.3 Confidentiality

You must keep all proprietary information confidential and not disclose it outside the course for any reason other than your personal learning.

5.4 Competing materials

You may not use TME's proprietary course materials, structure, sequencing or written content to create, produce or sell competing courses, workshops, manuals or training materials. This restriction protects TME's intellectual property and applies without time limit. It does not prevent you from teaching Pilates, working for any employer, or developing your own original material.

5.5 Account and access

Your login is personal to you and must not be shared. Access to online materials is granted to a single named participant. Concurrent access from multiple devices or locations that suggests account sharing may result in suspension of access and, where appropriate, termination of enrolment without refund.

5.6 Access duration

Course access may be limited in duration, and may be terminated if TME discontinues operations. Where practicable, TME will give reasonable notice before withdrawing access.

6. Conduct, Safety and Media‍ ‍

6.1 Participant conduct

You are expected to conduct yourself professionally and respectfully toward educators, TME staff, host studios and fellow students. TME reserves the right to remove any participant for disruptive, abusive or unsafe behaviour. No refund will be provided in such cases.

6.2 Health and safety

You must follow all health and safety guidelines during in person courses, including any requirements of the host venue and any applicable public health requirements. TME is not responsible for injuries, illness or incidents resulting from failure to follow these guidelines.

6.3 Disclosure of health conditions

You must disclose any injury, medical condition or pregnancy that may affect your safe participation in practical training before your first practical day, and advise us of any change during your course. TME may require medical clearance before you participate in practical components.

6.4 Photography and media

TME may photograph or film during practical days for training, promotional and marketing purposes, including social media. By attending, you consent to TME using this material. If you do not wish to appear, notify your educator in writing before the practical day and we will accommodate this.

6.5 Termination of enrolment

TME may terminate your enrolment at any time, at its sole discretion, without refund or compensation, including for breaches of these terms, disruptive conduct, or failure to meet course requirements.

7. Course Delivery and Changes‍ ‍

7.1 Course availability

TME reserves the right to cancel or reschedule any course, event or workshop. Participants will be notified and given the option to transfer to another course. Refunds will only be offered where no rescheduled option is available.

7.2 Course content changes

TME may update course materials, schedules and curriculum at its discretion. Participants will be informed of any significant change that materially affects the course experience.

7.3 Changes to these terms

TME may update these Terms and Conditions from time to time. The version in force at the date of your enrolment governs your participation, except where a change is required by law. Material changes will be notified by email.

8. Liability‍ ‍

8.1 Disclaimer

Subject to clause 1.2, TME, its owners, educators, employees and agents are not liable for injuries, damages or losses resulting from participation in courses or from application of course content. You are responsible for your own actions and outcomes when applying learned techniques.

8.2 Indemnity

Subject to clause 1.2, you agree to indemnify, defend and hold harmless TME, its educators, employees and agents from any claims, liabilities, damages, losses or expenses arising from your participation in the course or your conduct during it, except to the extent caused by TME's own negligence or breach.

8.3 Force majeure

TME is not liable for failure or delay in meeting its obligations due to circumstances beyond its reasonable control, including natural disasters, pandemics, government regulation, or venue closure.

9. General

9.1 Privacy and data protection

TME collects personal information for course administration and enrolment, and handles it in accordance with applicable privacy laws and TME's Privacy Policy.

9.2 Third party services

By enrolling, you agree to the terms and conditions of any third party service providers involved in course delivery or payment processing.

9.3 Transfer of rights

You may not assign or transfer your rights or obligations under these Terms without written consent from TME. Course places are personal to you and cannot be sold or given to another person.

9.4 Communication and notices

All course related communications, updates to terms and important information will be sent by email. It is your responsibility to keep your contact details up to date.

9.5 Legal consequences

Breaching these terms, including unauthorised sharing of content, may result in legal action.

9.6 Governing law

These Terms are governed by the laws of [Victoria, Australia]. You and TME submit to the non-exclusive jurisdiction of the courts of that State.

9.7 Severability

If any provision of these Terms is found unlawful or unenforceable, it will be severed without affecting the remaining provisions.
